Child custody and child support are most commonly addressed in three types of cases:

Regardless of which type of case brings the parents into the court system, the rules for determining child custody and child support are the same.  The statutes and the past precedents of court decisions do not, for the most part, differentiate between parents who are or were married and parents who were never married.

The law and the courts distinguish between two aspects of custody of children: “Physical Custody” and “Legal Custody.”

Missouri law explicitly states that Joint Physical and Joint Legal custody is preferred.  Absent a compelling reason to order sole physical or sole legal custody to one parent, you should be prepared and expect that you will receive joint legal and joint physical custody.
