Is Missouri a Mother State?

Missouri law does not give preference to either parent based on gender. Both parents have equivalent rights in custody and support decisions, and Mo. Rev. Stat. § 452.375 explicitly prohibits courts from favoring a parent based on age, sex, or financial status. The SB 35 rebuttable presumption of equal parenting time applies regardless of which parent is the mother or father. The best interests of the child remain the court’s governing standard in every case. What Rights Does a Father Have for Custody in Missouri?

Under Missouri law, an unwed father has no parental rights unless paternity is established. Paternity may be established voluntarily by completing an affidavit of paternity at any time from the child’s birth until the child turns 18. If the parents don’t agree, either parent may bring a court action to establish paternity. An affidavit alone, however, does not confer custody or visitation rights. To obtain those rights, a paternity suit must be filed.

Types of Child Custody in Missouri

Missouri statutes and court precedent don’t differentiate between married, formerly married, and unmarried parents in custody determinations. Courts address two types of custody: physical custody (where the child resides) and legal custody (decision-making authority over the child’s welfare, including education and healthcare).

A variety of custody arrangements may be ordered by the court, including:

• Joint physical and legal custody
• Joint physical custody to both parents, with one having sole legal custody
• Joint legal custody, with one parent having sole physical custody
• Sole legal and physical custody to one parent
• Custody or visitation granted to another party, such as a grandparent

Parenting Plans in Missouri

Missouri law requires a written parenting plan in any custody judgment under Mo. Rev. Stat. §§ 452.310 and 452.375. Both parents may submit separate plans, or they may submit one jointly agreed-upon plan. If parents can’t reach agreement, the court determines a plan in its discretion based on the child’s best interests.

A parenting plan typically addresses physical custody schedules for weekdays, weekends, holidays, and vacations, along with legal decision-making authority over education and healthcare, each parent’s financial responsibilities for child-related expenses, and procedures for resolving future disputes. Parental Relocation Rules in Missouri

When a custodial parent plans to move a child’s principal residence, Missouri law imposes specific notice and court-approval requirements. Under Mo. Rev. Stat. § 452.377, a parent seeking to relocate the child’s principal residence for 90 days or more must send written notice by certified mail to all parties with custody or visitation rights at least 60 days before the proposed move.

That notice must include the new address or city if the exact address isn’t yet known, the intended move date, the reasons for relocating, and a proposed revised parenting schedule. The non-relocating parent may file an objection, and the court must approve or deny the relocation. Courts weigh the request against the best-interests standard and the effect the move would have on the child’s relationship with the non-relocating parent.

Mediation vs. Litigation in St. Louis Child Custody Cases

Mediation involves a neutral third party who facilitates an agreement between parents outside of court. It typically takes less time and costs less than litigation, and it gives parents more control over the outcome than a contested hearing, where the final decision rests with a judge. Not every dispute is suited to mediation, however. What Makes a Parent Unfit in Missouri?

A parent is deemed unfit when they are unable to provide proper care for their child. Grounds for a finding of unfitness include:

• Mental illness that poses a threat to the child’s wellbeing

Can a Child Refuse Visitation?

While judges often consider a child’s wishes when making initial custody decisions, the child has less agency over when and with whom they spend time once a custody order is in place.

Children under 18 are required by law to abide by visitation orders. Failure to comply can result in legal consequences for the custodial parent, who may be seen as having violated the court order. If the court finds that the custodial parent intervened in the child’s visitation rather than the child independently refusing, that parent risks fines, makeup custody periods, and in some cases a transfer of custody to the other parent.

When a child is uncooperative with visitation, the matter can be brought before the court. The judge will assess the child’s age, maturity, and reasoning to determine whether the preference is independent and free of coercion, and whether grounds exist to modify the visitation order.

Do Grandparents Have Custody Rights?

Missouri courts presume it is in the best interest of the child to live with at least one biological parent. For a grandparent to be awarded custody, the court would need to find both parents unfit or unwilling to serve as primary guardian. With sufficient compelling evidence, grandparents can seek custody on the grounds that it may be best for the child.

While custody is a high bar, Missouri law does protect grandparents’ relationships with their grandchildren. Under Mo. Rev. Stat. § 452.402, biological grandparents may petition for visitation if:

• The child has lived with the grandparent for at least six months within the two years preceding the petition, and visitation has been unreasonably denied for more than 90 days
• The child’s never-married parents unreasonably deny visitation for more than 60 days
• The child’s parents are divorcing and the grandparent intervenes to seek visitation
• One of the child’s parents dies and the surviving spouse denies reasonable visitation

Grandparents may assert visitation rights regardless of the absent parent’s role in the child’s life. To establish regular visitation, however, grandparents must demonstrate that visits are in the best interests of the child by showing that they benefit the child’s health, safety, and overall wellbeing.
