Child Custody in Missouri
Missouri courts determine custody under the best-interests-of-the-child standard, governed by Mo. Rev. Stat. § 452.375. Effective August 28, 2023, Senate Bill 35 established a rebuttable presumption that equal or approximately equal parenting time with each parent is in the best interests of the child. That presumption can be overcome by a preponderance of the evidence. For example, a pattern of domestic violence or a parental agreement on a different arrangement may rebut it. Absent such evidence, courts begin from a starting point of equal time.
A child’s wishes are also a consideration when the child is mature enough to form an independent view. Issues related to child custody or support may arise during a divorce, a paternity case, or a separate child custody action.
Factors courts consider under the best-interests standard include:
- The wishes of the parents and any proposed parenting plan
- The child’s safety and emotional needs
- The child’s education and medical needs
- The need to maintain stability and continuity in the child’s life
- How well each parent can cooperate on co-parenting
- The need to maintain relationships with siblings, grandparents, and other close family members
- Whether either parent has problems with drug or alcohol abuse
- Whether either parent has been violent or caused physical or emotional harm
- The physical and mental well-being of both parents
- Relocation plans
